Terms & Conditions

1. Definitions

  • “Agent”: Any individual or organization acting on behalf of the Contractor.

  • “Contractor”: Silk Heat, including any of its employees and/or agents.

  • “Customer”: The individual or entity engaging Silk Heat's services.

  • “Site”: The location where services are to be carried out.

  • “Working Period”: The time frame agreed upon between Silk Heat and the Customer for the completion of work.

  • “Works”: The agreed scope of services to be provided by Silk Heat as per the attached quote.

  • “We”: Refers to the business "Silk Heat," its representatives, or anyone acting on its behalf.
     

2. Contractor’s Responsibilities
Silk Heat agrees to:

  • Carry out work carefully and competently in accordance with the contract.

  • Use materials that are new or refurbished, unless otherwise agreed with the Customer. If pre-existing or second-hand parts are requested by the Customer, Silk Heat does not provide warranties on those items.

  • Minimize health, safety, and environmental risks.

  • Notify the relevant authorities, such as Building Control or Gas Safe, where applicable.

  • Provide reasonable notice before any necessary isolation of water, gas, or electrical services.
     

3. Customer’s Responsibilities
The Customer agrees to:

  • Follow all safety warnings and instructions provided by Silk Heat.

  • Provide access to the Site during the agreed working hours.

  • Ensure the Site is clear of obstructions and restrict unauthorized individuals or pets from accessing the Site.

  • Obtain any necessary permissions (e.g., planning permissions or listed building consent) before work commencement.

  • Be responsible for timely payments, either as a single payment or in installments, according to agreed terms.
     

4. Payment Schedule

  • Deposit: A deposit of up to £500 may be required by Silk Heat, payable via cash, bank transfer, or credit card for deposits exceeding £500.

  • Payment Terms: Payments may be staggered based on milestones (daily, weekly, or per completed phase) as agreed before commencement.

  • Final Payment: Due upon satisfactory completion of work or within 14 days of the invoice date.
     

5. Facilities On-Site
Silk Heat may require access to:

  • Mains water tap

  • Gas meter and boiler

  • Toilet facilities

  • Mains electricity

The Customer agrees to provide such access to complete the work.

6. Use of the Silk Heat Website

  • Eligibility: Users must be at least 18 years old to make bookings, make payments, or enter into any contractual agreements.

  • Account Registration and Security: If account creation is required, users must provide accurate information and are responsible for maintaining the confidentiality of their login details. Any unauthorized use of an account must be reported to Silk Heat immediately.

  • Bookings: Bookings made through the website are considered binding agreements, subject to confirmation by Silk Heat. Cancellation policies may apply, and these will be communicated during the booking process.

  • Payments: Payments for services booked through the website are processed securely through third-party payment processors. Users must provide accurate billing information, and any payment disputes should be reported promptly to Silk Heat. Any unauthorized use of credit cards or payment details is prohibited and may result in termination of access to the website.

  • Communication: By providing contact details, users consent to receive communication from Silk Heat for booking confirmations, updates, and promotional materials. Users can opt out of marketing emails at any time.

  • Content and Blog: The content on the Silk Heat website, including blog articles and service information, is provided for general information purposes only. While Silk Heat strives to keep the information accurate and up-to-date, it is not responsible for any inaccuracies or omissions. Users are encouraged to seek professional advice before relying on any information from the website.

  • Prohibited Use: Users must not use the website for illegal activities, to harass others, or to post or transmit content that is defamatory, obscene, or violates third-party rights.

  • Intellectual Property: All content on the website, including text, graphics, logos, and images, is owned by or licensed to Silk Heat and is protected by intellectual property laws. Users may not reproduce, distribute, or use website content for commercial purposes without Silk Heat's express permission.
     

7. Limitation of Liability

  • Silk Heat is not liable for any indirect, special, or consequential damages, including but not limited to loss of profits, data, or business interruption, arising from the use of the website, its services, or any contractual agreements.

  • The total liability of Silk Heat under these Terms & Conditions is capped at the total amount paid by the Customer for the specific service giving rise to the claim.
     

8. Indemnification
The Customer agrees to indemnify and hold Silk Heat harmless against any losses, damages, claims, or legal fees arising from:

  • Breach of these Terms & Conditions

  • Unauthorized use of the website or its services

  • Violation of any third-party rights
     

9. User-Generated Content (UGC) and Comments

  • Users who post comments or content on the Silk Heat website, including blog comments or reviews, are solely responsible for the content they post. Silk Heat reserves the right to remove any content that is offensive, defamatory, or otherwise violates these terms.

  • By posting content, users grant Silk Heat a non-exclusive, royalty-free license to use, reproduce, and display their content for marketing or informational purposes.
     

10. Website Availability & Maintenance

  • Silk Heat endeavors to keep the website operational but does not guarantee uninterrupted service. Maintenance, technical issues, or other interruptions may occur, and Silk Heat will strive to resolve these issues promptly.

  • There is no warranty that the website will be free from bugs, viruses, or technical errors. Users are encouraged to use appropriate security measures when accessing the site.
     

11. Copyright Infringement Policy

  • Silk Heat respects intellectual property rights and will address any alleged copyright infringement promptly. If you believe that any content on the website violates your intellectual property rights, please contact Silk Heat immediately with relevant details.
     

12. Governing Law and Dispute Resolution

  • These Terms & Conditions are governed by English law. Any disputes arising from the use of the website or the services provided will first be attempted to be resolved through mediation. If unresolved, disputes may be subject to arbitration or court proceedings within the jurisdiction of English courts.
     

13. Severability

  • If any part of these Terms & Conditions is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

  • Silk Heat reserves the right to amend or update these Terms & Conditions at any time. Any major changes will be communicated through the website or by email. Continued use of the website and its services constitutes acceptance of any changes.

  • If any services are provided through third-party tools or platforms, users agree to the terms of those third parties, and Silk Heat disclaims responsibility for any issues arising from their use.
     

17. Cancellation and Cooling-Off Period

  • Customers have a right to cancel the agreement within 14 days of signing, in compliance with the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013. Notice of cancellation must be provided in writing to Silk Heat.

  • If the Customer requests work to start within the 14-day period, cancellation is still possible, but charges for work completed up until the point of cancellation will apply.

  • The cooling-off period may not apply to bespoke or urgent repair services.
     

18. Changes to the Completion Date

  • Silk Heat will strive to adhere to agreed timelines but may extend or alter the completion date due to unforeseen circumstances, including pre-existing issues at the Site that require rectification, adverse weather conditions, or other safety concerns.
     

19. Force Majeure

  • Silk Heat is not liable for delays or inability to fulfill contractual obligations due to factors beyond its control, including but not limited to:

    • Unavailability of materials

    • Adverse weather conditions

    • Strikes or industrial actions

    • Natural disasters or government orders

    • Discovery of health hazards like asbestos

  • In such cases, Silk Heat may terminate or postpone the contract, refunding any payments for uncompleted works.
     

20. Termination

  • Customer’s Right: The Customer may terminate the contract if Silk Heat acts recklessly, breaches a fundamental term of the agreement, or becomes insolvent.

  • Silk Heat’s Right: Silk Heat may terminate the agreement if:

    • The Customer fails to make payments as agreed, without a valid reason.

    • The Customer obstructs or prevents Silk Heat from safely or efficiently conducting the work.

    • The Customer becomes insolvent or files for bankruptcy.

  • If the contract is terminated by either party:

    • All outstanding payments will become due and payable immediately, according to the agreed payment terms or as outlined in writing between the parties.

    • If Silk Heat terminates the agreement, it retains the right to keep any monies paid up to the point of termination and any materials or resources ordered for the work.

  • Notice of Termination: Either party wishing to terminate the agreement must do so in writing, with clear notice provided and reasonable opportunity given for any breach to be rectified before final termination.
     

21. Warranties and Liabilities

  • Standard Warranties: Silk Heat provides standard warranties on its workmanship, with the duration and extent specified in the work agreement.

  • Limitations: The warranty does not cover normal wear and tear, third-party interference, or issues arising from the Customer's failure to maintain the property properly.

  • Manufacturer Warranties: Any product warranties are the responsibility of the manufacturer, and the Customer must comply with any servicing or maintenance requirements. Silk Heat will not be liable for manufacturer defects or warranty disputes.
     

22. Payments, Refunds, and Disputes

  • Accepted Payment Methods: Payments are processed securely via credit card, debit card, or bank transfer. The Customer is responsible for ensuring sufficient funds and accurate payment information.

  • Refund Policy: Refunds are issued at Silk Heat's discretion in accordance with UK consumer protection laws. Refunds may be subject to deductions for work completed, costs incurred, and any additional charges outlined in the agreement.

  • Dispute Resolution: Customers should report any issues or disputes with Silk Heat's services promptly to seek resolution. If unresolved, disputes may be escalated to mediation or legal proceedings, subject to UK law.
     

23. Privacy Policy

  • Data Protection: Silk Heat is committed to protecting users' privacy. Any personal information provided through the website is handled in compliance with data protection laws, including the UK GDPR and Data Protection Act 2018. 24. Rights to Suspend or Cancel Accounts

  • Silk Heat reserves the right to suspend or cancel any user account or booking if there is a breach of these Terms & Conditions or suspected fraudulent activity. Suspensions or cancellations will be communicated to the affected user, who may contact Silk Heat to address the issue. Accounts may also be suspended for security reasons or for maintenance of the site.
     

25. Entire Agreement

  • This document, including any additional terms provided for specific services or bookings, represents the complete Terms & Conditions governing the agreement between Silk Heat and the Customer. Any verbal agreements or understandings are superseded by these written terms unless expressly noted in writing.
     

26. Jurisdiction and Governing Law

  • These Terms & Conditions are governed by and construed in accordance with English law. Any disputes or claims arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
     

Acceptance of Terms & Conditions
By accessing the Silk Heat website, making bookings, or engaging in any services offered by Silk Heat, you agree to abide by these Terms & Conditions. If you do not agree to any part of these terms, you should not use the website or engage with Silk Heat services. Continued use of the site constitutes acceptance of these terms.
